By accessing or using CaptainsLog at captainslog.live ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use the Service.

2. Description of Service

CaptainsLog is a personal journaling and goal-tracking application for creating, managing, and analyzing personal thoughts and objectives.

3. User Accounts

• You must provide accurate information when registering.
• You must be at least 13 years old to use this Service.
• You are responsible for maintaining account security, including passwords and MFA codes.
• One account per person.

4. Privacy and Data

4.1 Data Storage

• Your data is stored on secure servers in the United States by our hosting provider, Fly.io.
• Your journal entries are private and encrypted using industry-standard methods.
• We do not sell or share your personal data with third parties, except as required to provide the Service (e.g., hosting).

4.2 Account Deletion

• You may delete your account at any time from your account settings, permanently removing all associated data (including journal entries, goals, and authentication tokens) instantly.
• This action cannot be undone.

5. Acceptable Use

You may not use the Service to:

• Store illegal content or plan illegal activities.
• Harass or threaten others.
• Attempt to compromise the Service's security (e.g., bypassing MFA).
• Violate any applicable laws.

6. Content Ownership

• You retain ownership of all content you create.
• You grant us a limited license to store and display your content solely for providing the Service.
• You are responsible for the legality of your content.

7. Service Availability

• We strive for reliable service but cannot guarantee 100% uptime.
• We may modify or discontinue features with reasonable notice.
• We are not liable for temporary service interruptions.

8. Termination

We may terminate your account for:

• Violation of these Terms.
• Fraudulent or illegal activity.
• Inactivity exceeding 24 months.

9. Disclaimers

• The Service is provided "as is" without warranties.
• We are not responsible for data loss due to technical issues.
• You use the Service at your own risk.

10. Limitation of Liability

• Our liability is limited to the maximum extent permitted by law.
• We are not liable for indirect or consequential damages.

11. Data Processing and User Rights

• By using the Service, you consent to your data being processed and stored in the United States, protected by industry-standard encryption and Standard Contractual Clauses for international transfers.
• EU users have rights under GDPR, including access, rectification, erasure, restriction of processing, and data portability. California users have CCPA rights, including the right to know and delete their data.
